What is a Capital Car Park Control fine?

Capital Car Park Control issues private parking tickets to people who use the car parks they manage without paying or for overstaying. These parking tickets are commonly called Parking Charge Notices. 

They will either issue the parking ticket by leaving it on your vehicle, or if the offence is caught on camera, they will send the Parking Charge Notice2 in the post.

They send a Notice to Owner3 to the registered vehicle owner as per DVLA records. This gives the vehicle owner 28 days to state someone else was driving – if that is true. 

I was recently featured in The Sun about parking tickets, where I encouraged everyone to check whether the ticket was issued by a member of a trade association. If they aren’t, then they probably can’t get your details from the DVLA to pursue you.4

Do you have to pay Capital Car Park Control?

You only have to pay a Capital Car Park Control parking ticket if a court has ordered you to pay. The reason for this is that Parking Charge Notices are comparable to invoices rather than fines. 

To make you pay these “invoices”,  the company needs to get a court to rule in their favour. This will happen if they take you to court and prove you didn’t pay or overstayed by more than ten minutes.

However, Capital Car Park Control would also need to show they operated a car park to legislation, such as having correct signage. 

Appeal Process Steps

If you believe the ticket was unfairly issued, you have the option to appeal. Here’s a table that explains the process.

Process: Steps you should take:
When you receive the ticket… You should gather as much evidence as you can to support your appeal claim and prove that the ticket was unfairly issued.
If you were given the ticket in person/attached to your car… You must make an informal appeal (sent to the local authority/council that issued the PCN) within 14 days. This should be a letter with the evidence proving why the ticket was incorrectly given.
If it was posted to you… You will be given 21 days to submit an informal appeal (from the day you received the letter). Your informal appeal should be a letter with the evidence proving why the ticket was incorrectly given.
If the informal appeal is rejected… You will receive a Notice to Owner and will have 28 days to respond to this with a formal appeal. You can conduct the formal appeal online or via paper form. The Traffic Penalty Tribunal can send you one of these forms.
If the formal appeal is rejected… You will receive a Notice of Rejection. From here, you are free to challenge the council’s verdict at an independent tribunal.
If the independent tribunal disagrees with your appeal… You should pay the ticket within 28 days of the tribunal rejecting your appeal. If you don’t, the fine will be increased by 50%.
If you don’t have the money to pay the fine, you should contact Citizens Advice or another debt charity.

Capital Car Park Control Ltd states that they will reply within 35 days but you shouldn’t assume the appeal has been accepted if they take longer.

The law states they have up to 56 days to reply, and if they don’t respond within this timeframe the appeal must be accepted.

Will Capital Car Park Control take you to court?

So, the big question is will they? Will Capital Car Park Control take legal action against someone who ignores the deadline to pay a Parking Charge Notice?

If you read advice online, you’ll probably feel confident that you’ll never be taken to court. Many forum users state that they’ve ignored PCNs in the past and never had to pay. This could be true, but it’s not always the case.

There is always a risk of getting taken to court and made to pay. If this happens, you may have further expenses to pay as well. 

Be aware that Capital Car Park Control are likely to threaten legal action no matter their intentions. They will make legal threats anyway as a strategy to intimidate you and get you to give in and clear the “fine”.
