What is a Sutton parking fine?

A Sutton parking fine refers to a Penalty Charge Notice issued by Sutton Council in London. Penalty Charge Notices aren’t just served to motorists for parking contraventions. They can be issued for traffic offences and transport groups can issue them when a motorist misses a road toll deadline, such as the London Congestion Charge.

Sutton council workers might place a PCN on your car if they notice you haven’t paid for parking or have overstayed. But you can also receive a PCN in the post if the contravention was seen on camera.

How much is a fine for parking in London?

Penalty Charge Notices issued by London Borough Councils usually cost either £80 or £130, depending on the location of the parking contravention within the council area and/or the seriousness of the contravention. However, you can get 50% off the parking fine if you pay within 14 days. 

For example, if you receive an £80 parking ticket from Sutton Council and pay it within a couple of days, you’ll only be asked to pay £40. 

Is a PCN a civil penalty?

A Penalty Charge Notice is not considered a criminal offence. Thus, it is a civil penalty and if you don’t pay it becomes a civil debt. 

Do you have to pay a Sutton parking fine?

You have to pay a Sutton parking fine from the local council within 28 days. The only occasion when you don’t have to pay a Sutton Council parking fine within 28 days is if you’re lodging an appeal. But the appeal must be made within the same 28 days instead. 

What happens if you don’t pay a Sutton PCN?

Your fine is increased if you don’t pay the Penalty Charge Notice within 28 days. The council will serve you a “charge certificate” which increases your fine by 50% of its value. So if your original fine was £80, you will now owe £120. This money has to be paid to the local authority in full within 14 days. 

When the inflated fine isn’t paid within 14 days, the local authority can escalate the matter to the civil courts. A judge will make you subject to an order of recovery, making it your legal responsibility to pay. If you’re experiencing financial difficulty, let the council know and ask for a solution.

Otherwise, the council can employ bailiffs to collect the civil debt or seize goods to be sold at an auction. They add expensive bailiff fees to this process, which are best avoided. 

How to pay a PCN Sutton Council

You can pay a PCN Sutton by cash, cheque or over the phone. Yet, one of the easiest ways to pay is by making the payment on the council’s website. You’ll need your PCN reference number to make any type of payment because this is what identifies your fine. If you have lost it, you should contact Sutton Council. 

Can you appeal a Sutton parking fine?

You can appeal a Sutton parking fine as long as your appeal is submitted to the council within the 28 days you get to make a payment. The council won’t accept a PCN appeal from anybody who has waited longer than 28 days to submit the challenge. In fact, by this time you’ll be due the charge certificate and a bigger fine.

Don’t pay the fine if you plan on appealing. Any payment is considered accepting liability and would make your PCN appeal redundant. 

How do I appeal a Sutton parking ticket?

You can appeal a Sutton parking ticket through the council website. This is officially known as a representation. You must state your arguments against the parking ticket clearly and attach any evidence you have to support your arguments. You can also view the evidence against you in the process, such as images from CCTV. 

Sutton PCN – appeal or pay? 

You might be in a predicament when deciding whether to pay or appeal the PCN. 

On the one hand, you think the PCN shouldn’t stand, and you shouldn’t have to pay a penny. But on the other, appealing will lose you the opportunity to pay a reduced fine for clearing the payment within 14 days. If your appeal is rejected, you’re left paying more than you otherwise would have needed to. 

The decision should be based on your personal preferences and the strength of your appeal. Nobody else can make this tough decision for you.

Can you do anything after a PCN appeal rejection?

The council rejecting your PCN doesn’t have to be the end of your appeal. You can take any rejected appeal to an independent tribunal for a second opinion. The council will explain how to do this if they reject your arguments. You must be told in writing.
