Parking Fines UK

Identify the notice before deciding what to do. Council Penalty Charge Notices, private Parking Charge Notices and police fixed penalties use different legal procedures.

In this easy-to-understand guide, we’ll cover:

  • The main types of parking notice and their different procedures.
  •  If you need to pay a council or private parking fine.
  •  What could happen if you don’t pay these fines.
  •  If parking fines can affect your credit score.
  •  How long a parking fine lasts before it expires.

This guide focuses on council PCNs and private contractual charges. Police and other statutory penalties require their own response.

Don’t worry; we’ve got helpful advice and examples to guide you.

Do you have to pay a private parking fine?

Check the terms, signs and evidence for the actual parking event. General ticket statistics do not decide whether your demand is valid.

If you disagree, use the correct challenge process promptly rather than ignoring the notice.

However, private car park operators actually have the legal right to issue tickets if you don’t play by their parking rules.

But here’s the twist: these tickets are not considered a real fine. They’re instead considered the same as an invoice from the company.

A valid private parking debt can be owed before a court judgment. Check the parking terms, evidence, amount and whether the person pursued is legally liable.

A disputed private charge can lead to a civil claim. Enforcement agents require the appropriate judgment and enforcement authority; a collector’s letter alone is insufficient.

Do you have to pay a council parking fine?

Use the payment or challenge period on the council document. A windscreen PCN, Notice to Owner and postal PCN can involve different stages.

Council discounts commonly last 14 days, with 21 days for some postal parking notices. Check the exact discount period.

For formal representations under the England and Wales traffic-management parking framework, the authority normally has 56 days to respond. This is not a universal deadline for informal challenges, private appeals or every PCN scheme.

A formal Notice of Rejection normally explains the relevant independent tribunal route and deadline. An informal rejection may instead precede the formal stage.

Here’s a quick table that will walk you through the appealing process.

When Action
On receiving a council PCN Read the notice, keep it, gather evidence and note all payment and challenge deadlines.
Windscreen or handed-to-driver PCN An informal challenge may be available before the Notice to Owner. Early challenge can preserve a discount under the authority’s policy; 14 days is not a universal final appeal deadline.
Postal PCN or Notice to Owner Normally make formal representations within 28 days as stated on the notice. Do not assume there is an extra informal stage.
Representations rejected The Notice of Rejection explains how to appeal to the appropriate independent tribunal, normally within 28 days.
Appeal unsuccessful Pay by the deadline given in the decision or obtain advice on any available review. Further statutory charges can follow if you do neither.
Other ticket type Private parking charges and FPNs use different procedures; follow the actual notice.

What to include in your parking appeal

Include the notice reference, your reasons, supporting evidence and the action you want the issuer to take.

The correct process depends on the notice and where it was issued.

How much is it?

The cost of a parking fine differs between Penalty Charge Notices and Parking Charge Notices. Moreover, there are different fine amounts and potential discounts for each type of fine.

There is no single UK tariff. Current London borough parking amounts are £160/£110 in Band A and £140/£90 in Band B, depending on contravention level; other locations have different amounts.

The location, legal scheme and contravention determine the amount. Read the actual notice.

A council PCN commonly offers a 50% discount, but the qualifying period depends on the notice and scheme.

The government’s 2022 private parking code was withdrawn. Its proposed £50/£70 limits did not become a universal statutory cap. Industry-code limits and transitional rules are separate.

The sector code generally provides an initial charge ceiling of £100 and at least 40% discount for payment within 14 days, subject to applicable qualifications. Check the code and notice.

What happens if you don’t pay?

A council charge certificate can increase a PCN by 50% only when the statutory conditions are met. A timely challenge or appeal affects the process. Debt registration, an Order for Recovery and a warrant are later stages, not an automatic result on day 29.

A charge certificate normally gives 14 days from service to pay. Standard representations are usually no longer available at that stage, but later statutory recovery remedies may apply on specific grounds.

But what happens if you don’t pay the new fine amount?

If unresolved, the authority may register the debt at the Traffic Enforcement Centre and obtain an Order for Recovery. This is not an ordinary CCJ on a credit file.

A later warrant can authorise enforcement if the statutory steps are completed. Registration costs and lawful enforcement fees can increase the balance.

What happens if you don’t pay a private parking ticket in the UK?

If you don’t pay a private parking ticket you are likely to receive further payment requests and legal threats.

Distinguish routine reminders from a formal letter before claim and actual court papers. Each needs the appropriate response.

The letter might be sent directly from the car park operator, or they may have outsourced the collection process to a debt collection agency.

It’s important to know that a debt collection agency isn’t the same as a bailiff company. Debt collection businesses are just like administration companies trying to get you to pay. A bailiff is someone who enforces debt collection (among other tasks) with a court order already issued.

If the car park company decides to take legal action, they might win a court order to make you pay.

An unpaid judgment can lead to a separate enforcement application. Do not assume legal threats will be abandoned, or that an ordinary debt collector can seize goods.

But this is a huge risk.

There are plenty of examples around of private companies taking legal action against people to claim their fines.

Do they expire?

Council PCNs follow statutory service and enforcement rules. Delay can matter, but there is no simple universal expiry date or rule that every old PCN disappears.

The authority must follow the required stages. Check the document, service history and any available statutory remedy.

In England and Wales, a simple-contract private parking claim normally has a six-year limitation period from accrual, with qualifications for acknowledgment, payment and proceedings. Scotland generally uses five-year prescription under its own rules. Existing judgments are separate.

Will it affect your credit rating?

Experian states that private parking fines don’t affect your credit rating in most cases.

A demand being passed to a debt collector does not by itself register a CCJ or create a credit-file default for that parking charge.

An England and Wales CCJ can affect a credit file, normally for six years. Payment in full within one calendar month can allow removal; later payment normally marks it satisfied. Civil PCN debt registration is not the same process.
