There is no single deadline after which every energy debt disappears. Ofgem’s back-billing rules and the legal time limits for bringing a debt claim answer different questions. This guide focuses on household energy in Great Britain.

What is the 12-month back-billing rule?

Ofgem’s back-billing protection can prevent a household being charged for previously unbilled energy used more than 12 months earlier where the rules apply. It is not a blanket cancellation of every unpaid bill once it reaches 12 months old. Exceptions can apply where the customer has behaved obstructively or manifestly unreasonably. Ask the supplier to explain the billed dates, previous statements and basis for any exception, and check Ofgem’s guidance.

The protection can apply when the supplier did not accurately bill or inform you of the charges, including some situations where a Direct Debit was set too low. It does not allow someone to ignore an accurate bill for a year and then demand cancellation.

How do I challenge a back bill?

Ask for the billing period, readings, tariff, previous statements and payments. Explain which charges you dispute and why you believe the back-billing rule applies. Keep copies and ask the supplier to identify any exception it relies on. Seek advice if a large back bill or collection deadline is involved.

What happens after five or six years?

For many energy-bill claims, the relevant time limit is generally six years in England and Wales or five-year prescription in Scotland, but the legal starting point, payments, written acknowledgment and court action matter. These rules differ from Ofgem’s 12-month back-billing protection. An existing judgment changes the enforcement position; do not assume it expires under the ordinary bill limitation rule. Get advice before relying on limitation, acknowledging an old debt or ignoring court papers.

In England and Wales, being statute-barred does not ordinarily erase the debt; it affects the court remedy. Scottish prescription has a different legal effect. A court claim issued in time or an existing judgment requires separate analysis. Do not rely on a simple countdown from the last unpaid bill.

Can the supplier use debt collectors or court action?

A supplier can instruct a collection agency or consider a court claim for a recoverable debt. A collection agency has no bailiff powers merely by being instructed. Any court papers need a response within the stated deadline, even if you dispute the bill or believe the claim is too old.

Energy Debt Solution How It Can Help Pay Off Your Energy Bills
Installment Plan Pay in smaller and more manageable monthly amounts until the debt is cleared
One-Off Payment Reduce debt, and possibly get a discount, by paying a lump sum
Appealing for a Bill Reduction Get a reduction by providing evidence of errors in your energy bill or a detailed explanation of your situation
Negotiate Contracts Ask for a temporary reduction in tariffs, a pause on payments, or a longer-term payment plan
Switch Providers If your current energy tariff is too high, consider switching to a cheaper provider
Supplier hardship support Ask your current supplier about its current debt-support fund, payment plans and eligibility. Also check independent charitable support such as the British Gas Energy Trust where available.
Benefits and seasonal support Check current eligibility for the schemes operating in your UK nation. Seasonal heating payments and discounts have different rules and are not all available to everyone.
Other local support Ask your council or a free adviser about current local energy support. Do not assume an earlier alternative-fuel payment scheme remains open.
Seek Advice from Debt Charities Debt charities offer free advice and practical solutions – they can help you understand your options, negotiate, and set up payment plans with energy providers.

Breathing Space in England and Wales is temporary protection for qualifying debts, not money or a grant. A debt adviser must assess eligibility.

Explaining that you cannot afford payment does not guarantee that legal action is impossible. It should prompt an affordability discussion and appropriate support; provide a realistic budget and ask for confirmation of any hold.

Can the supplier force a prepayment meter or disconnect me?

In Great Britain, involuntary prepayment is a last resort subject to strict Ofgem safeguards, whether by installation under warrant or remote switching of a smart meter. The supplier must try other recovery options and assess whether it is safe and suitable. Protected circumstances include specified serious health needs, households with a child under two and certain unsupported older households. Tell the supplier about everyone’s needs and check the full protection rules; unpaid debt alone does not give an unrestricted right to force a meter change.

Household disconnection for debt is a last resort subject to safeguards. Tell the supplier about any vulnerability or medical need and get urgent help if loss of supply is threatened. If prepayment credit runs out, ask immediately about emergency and additional support credit and affordable repayments.

Will the debt affect my credit file?

Missed payments or defaults can affect your credit file if the supplier reports them. It is wrong to assume reporting can happen only after referral to a debt collector, or that every missed bill is automatically reported. Ask the supplier what it shares and check the file for errors. Moving to prepayment does not automatically erase an existing reported debt or default.

See Experian’s UK guidance. A reported default normally remains for six years from its date. Credit-record retention is not the same as the legal limitation period.

Can I obtain help or a write-off?

Ask the supplier about affordability support and any currently open hardship fund. A grant, discretionary write-off or formal debt solution has its own conditions. Financial hardship does not automatically entitle every customer to free energy or cancellation of an accurate bill.

A free debt adviser can assess current essential energy costs separately from old arrears and compare options. Some formal solutions can include qualifying utility arrears, but eligibility, fees, credit impact and other consequences need review. See Ofgem’s support guide.

Where can I complain?

Complain to the supplier first and retain the complaint date, evidence and replies. An eligible unresolved complaint can normally be referred to the Energy Ombudsman after eight weeks or earlier with a deadlock letter. Check the Ombudsman’s process.

Water bills use different rules and complaint routes. Ofgem regulates energy; Ofwat regulates water in England and Wales. Do not apply an energy back-billing rule to a water account.
