How to challenge it

Private operators must comply with consumer law and the code applicable to their accredited scheme. Do not assume every operator is a BPA member; IPC members have a different scheme and independent appeal route.

Council PCNs and police penalties follow their own statutory procedures. A private-parking letter is not a substitute for a council representation or court response.

When you feel the fine you got was unfair, prohibitive, or issued incorrectly, you have the right to appeal.

Check the notice, evidence and whether liability is alleged against you as driver, keeper or another responsible party.

A charge is neither automatically valid nor optional. If disputed, respond through the correct process and on time.

What you can do if you get one on private land

When you receive a private parking charge, consider the following steps:

Note: It would be a mistake to ignore a parking ticket you get on privately owned land. Even when you feel it’s unfair, ignoring it could be a costly mistake due to private parking enforcement methods.

Parking Charge Notice vs Penalty Charge Notice

A private Parking Charge Notice normally alleges a contractual liability. The fact that it is not a statutory fine does not make the demand optional.

Council Penalty Charge Notices arise under the legislation for the relevant civil enforcement scheme. Their liability, challenge and enforcement rules differ from private contracts.

A valid private parking debt can be owed before a court judgment. Check the parking terms, evidence, amount and whether the person pursued is legally liable.

What grounds can support a parking appeal?

The following are possible issues to assess against the facts and applicable rules. None is an automatic cancellation reason in every case:

  • Your vehicle was parked correctly
  • The car park’s signs and road markings were not clear
  • You couldn’t pay because the machines were broken
  • The amount is not supported by the contract or applicable law.
  • You were not the driver and no other valid basis for liability, such as compliant England and Wales keeper liability, applies.
  • You were unable to get back to your vehicle for a valid reason
  • You were broken down
  • A required grace period was not allowed in the circumstances.

A machine fault may support an appeal, depending on alternative payment options, signs and circumstances. Provide evidence and consider asking the landowner to cancel. A landowner complaint is not a mandatory first step and does not pause the operator’s deadline.

How long do I have to challenge it?

An initial private appeal commonly allows 28 days, but use the period and submission route on the actual notice and applicable code.

Submit the relevant grounds and evidence in time. An early appeal does not guarantee a quick decision or successful outcome.

Applicable codes require recovery to pause during a qualifying timely appeal. Do not assume every message suspends all deadlines, and respond separately to any court papers.

You’ll find plenty of appeal letter templates online. However, be careful to use a template covering Parking Charge Notices and not Penalty Charge Notices.

Appealing a Fine

There is a set procedure to follow when you appeal a parking ticket on private land:

1. Reach out to the parking operator

Contact the parking operator and tell them why you are challenging the parking fine. Ask them to withdraw the ticket. You can also contact the landowner and request they withdraw the parking fine. An example is a supermarket owner.

Provide relevant, accurate evidence such as payment records, sign photographs or documents about a vehicle sale. Quality and relevance matter more than volume; ownership and driver liability are different issues.

You can use appeal templates provided by Citizens Advice. The two templates cover an appeal because the ticket was unfair or because you had a good reason for being late.

2. File with an independent appeals service

An eligible operator rejection explains the independent service and deadline. The outcome depends on your grounds and evidence, not an unsupported rejection percentage.

Observe the independent service’s eligibility and submission deadline. Recovery should pause under the applicable rules while the appeal is considered, but court paperwork must still be addressed.

3. Do it on the POPLA or the IAS Website

BPA-scheme operators generally use POPLA. You normally need a 10-digit code and must appeal within 28 days of rejection. Scotland and Northern Ireland POPLA appeals must be from the driver or a representative of an identified driver.

IPC-scheme operators generally use IAS. The standard appeal deadline is currently 28 days after rejection. A separate non-standard appeal may require operator consent and a £15 fee; its rules and binding effect differ.

You can file an appeal with IAS on their website. However, you must provide evidence to support your appeal.

A communication during an appeal is not automatically harassment. If recovery breaches the applicable rules, preserve the evidence and complain through the relevant operator and trade-body process.

Downloading, editing and sending a letter

Adapt the template to your actual grounds and remove irrelevant statements. Keep a copy of the completed appeal and evidence, including proof of submission.

Submit the appeal through the verified operator route. Requesting or downloading a template does not itself lodge an appeal. Check for acknowledgment and do not assume a reply will arrive within a few days.

If no response arrives within the applicable code period, check receipt and seek advice or use the complaint route. Do not assume silence automatically cancels every private charge.

Include any evidence you have, such as:

  • Time-stamped videos
  • Photos of signs that are hard to see or understand
  • Mobile app receipts
  • GPS location logs
  • A valid pay and display ticket
  • A repair note, if your car broke down

What happens if your appeal is rejected?

After rejection, read the decision and consider any remaining independent appeal, payment or legal options. Losing an operator or standard independent appeal is not itself a court judgment.

If an appeal succeeds, the charge should be cancelled under that process. Court costs do not arise merely because an operator appeal succeeded; a court claim follows separate rules.

Payment commonly closes the parking appeal route. Writing “under protest” does not guarantee a later refund or a successful claim. Obtain advice before paying with the intention of suing to recover the money.
