Historical Child Support Agency arrears and current Child Maintenance Service payments can involve different rules. This guide focuses on Great Britain; Northern Ireland has its own administration and appeal arrangements.
This article we’ll cover:
- Working out child maintenance using a calculator.
- Understanding CSA arrears law.
- Finding out CSA arrears time limit.
- Learning how to appeal the CSA amount for child support.
- Knowing how much can CSA take from your wages for arrears.
Check the scheme, decision dates and payment record before deciding how to challenge or repay arrears.
Don’t worry! This guide will help you know more about the CSA and how to manage child maintenance issues.
Let’s dive in.
This is a guidance tool only and not an assessment. For accurate child maintenance assessment, contact the Child Maintenance Service. Do not rely solely on this calculator’s results.
Changes made to the UK child support system
Let me give a quick overview of the changes made to the UK child support system.
In Great Britain, the Child Maintenance Service administers the current statutory scheme through the Department for Work and Pensions. Private arrangements and older CSA arrears need to be distinguished from current CMS assessments.
The statutory scheme is governed by child-support legislation. It does not guarantee that every family receives every payment owed.
Previously, the Child Support Agency (CSA) was responsible for this process.
The CMS introduced the current scheme from 2012, and CSA cases with ongoing maintenance liabilities were subsequently closed. Historical CSA arrears may still be handled under the relevant recovery arrangements.
The CSA is not an ongoing parallel service for new payments. Use the CMS or the department named on the current historical-debt notice to check your case.
What is the CSA arrears law?
According to the Child Support Payments Laws UK, both parents of a child are legally accountable for the cost of raising them.
If you’re separate from the other parent, the one who doesn’t have the child on a day-to-day basis is often responsible for making payments.
If arrears are correctly assessed and remain recoverable, they need to be addressed. Ask for a breakdown and advice if you dispute the calculation, payments credited or recovery status. See related guidance.
CMS can use statutory recovery measures. Contact it about affordability and any error promptly; a payment offer does not guarantee that enforcement will be paused.
There is no single repayment period or percentage for every arrears case. A deduction from earnings normally protects 60% of net earnings under the relevant rules, rather than 60% of gross income.
However, the exact amount depends on your circumstances, both in life and financially.

How do you go about paying back child support arrears?
If you have been told you owe child-maintenance arrears, check whether the balance relates to the current CMS scheme or a historical CSA case.
Although you may want to rush to pay back the money, it’s best to go through the due process first.
Check each notice and its deadline. Ask CMS for the periods covered, the calculation and a full payment history; do not assume every arrears letter requires the same response.
An affordable repayment arrangement may be possible, but it is not guaranteed. Explain your income, essential spending and relevant circumstances and request written confirmation.
Do not ignore a notice. Ask for the balance and recovery decision in writing and respond within any stated deadline.

Is there a time limit?
Do not apply the ordinary six-year consumer-debt rule to child-maintenance arrears. Historical scheme rules and the particular recovery method need checking.
A collection policy or repayment target does not automatically cancel arrears after two years. Ask CMS to explain the proposed period and affordability assessment.
CMS may use a deduction from earnings order without first obtaining an ordinary CCJ. Deductions from bank accounts and other enforcement methods have separate legal conditions. See related guidance.
A liability order can support further enforcement, while a charging order can secure an interest in property under the applicable procedure. These are different steps.
A charging order does not itself force the property to be sold; an order for sale is a separate process. Enforcement against goods also has notice, entry, ownership and exemption safeguards.
A child-maintenance liability order should not be described as an ordinary CCJ with an automatic six-year entry. Ask CMS what information has been shared with credit-reference agencies and how to correct any error.
Get advice promptly if you receive court or enforcement papers, whether you plan to pay, ask for affordable recovery or dispute the amount.
How far back can they claim arrears?
Very old maintenance arrears do not automatically disappear, but the scheme, dates and enforcement method matter. Ask for the decision and payment history before accepting or disputing a historic balance.
So, even if you’ve not heard about your child support payments for many years, you may still receive a call or letter about it in future.
The age of an alleged debt alone is not evidence that the balance is correct. Request the underlying assessment and details of any write-off or earlier collection decision.
Special historical restrictions can affect court enforcement of older CSA arrears. Get advice on the exact period and scheme rather than relying on a single date as a universal answer.
Having said that, it is vital to keep up with your child support payments to avoid falling into arrears.
Here are some helpful tips:
- Keep up with your child support payments by setting reminders or standing orders.
- Seek free guidance from MoneyHelper or an appropriate debt or family-law adviser if you are falling behind. MoneyHelper is a public guidance service, not a charity.
- Respond to any liability-order or enforcement notice within its deadline and seek advice if the amount or procedure is disputed.
How to appeal the amount for child support
You may want to challenge the CSA arrears because you feel the amount is more than you should pay.
For an appealable CMS calculation decision in Great Britain, the usual route is mandatory reconsideration followed by the Social Security and Child Support Tribunal. Historic decisions and Northern Ireland can use different procedures.

Here’s how to go about the CSA arrears appeal process:
Step 1: Ask CMS for mandatory reconsideration within 30 days of the decision letter, giving reasons and evidence. Ask about a late request promptly if that period has passed.
The reasons could be:
- The calculation uses incorrect income, care or family information. See related guidance.
- A relevant change of circumstances has occurred; report it and ask whether the decision should be revised or superseded.
- Relevant income or expenses may need to be considered through the variation rules.
Step 2: If dissatisfied after mandatory reconsideration, appeal to the Social Security and Child Support Tribunal within one month of the decision. Do not wait until the month has expired; a late appeal needs an explanation.
Step 3: Use form SSCS2 and follow its submission instructions, including the mandatory reconsideration notice and supporting evidence. A service complaint is separate from an appeal about the calculation.
The outcome may either increase or reduce the amount of child maintenance arrears you ought to pay.

Are CSA arrears written off?
Some historical CSA arrears have been written off under specific statutory and policy arrangements. That does not mean current maintenance or every old balance can be cancelled.
Ask CMS to establish the exact status of the debt. Relevant questions include:
- Which scheme and periods created the arrears, and who was entitled to receive them?
- Has the balance already been considered under the historical CSA arrears strategy?
- Has a formal write-off decision been issued, rather than recovery merely being paused?
- What representation or challenge deadline is stated in the decision letter?
The department must apply the relevant legal rules and policy to the case. Keep any written decision and obtain advice if the information used appears wrong.
Do not assume every write-off decision has the same appeal route or that no challenge is ever available. Ask for written reasons and seek advice about representations, complaints or judicial review where appropriate.
How much can be taken from your wages for arrears?
CMS has statutory powers to recover maintenance arrears; not every deduction requires a separate court judgment.
This can mean that the money is taken directly from your bank or even your paycheck.
For a deduction from earnings order, the protected earnings amount is normally 60% of net earnings. The employer deducts according to the order and rules. This is not a guarantee that the remaining sum covers every household’s essential costs.
The UK term is deduction from earnings. If deductions or arrears recovery cause hardship, contact CMS with a budget and seek advice. See related guidance.
If deductions cause hardship, contact CMS using the details on the current notice and ask it to review recovery. Explain essential spending and obtain independent advice.
Unpaid recoverable maintenance can lead to further enforcement. If you dispute the balance or cannot afford payments, raise the issue promptly rather than ignoring notices.
How to dispute arrears?
Like any organisation, the CSA and CMS do get things wrong from time to time.
If you feel that they have wrongly stated you have a case in arrears, you can contact them to discuss the matter.
When dealing with child support arrears disputes, it’s important that you have all of the necessary information at hand.
Make sure to track down any paperwork you have in relation to your case.
This can include things like past letters and bank statements. With this information, you can more effectively dispute your case.
Are CSA arrears written off if self-employed?
Being self-employed does not automatically cancel arrears or remove responsibility for maintenance.
The assessment depends on the paying parent’s income and the scheme’s rules. Disputed income, diversion of income or additional income may need investigation or a variation.
CMS generally starts with gross income information from HMRC, with rules for current income, changes and adjustments. Self-employed business turnover is not automatically the same as the parent’s assessable income.
Ask CMS which income year, evidence and adjustments were used, particularly for a new business or a substantial income change. Do not substitute turnover for taxable profit without checking the rules.
How to claim CSA arrears?
CMS does not simply enforce unpaid sums from every private family arrangement. A parent may be able to apply to CMS for statutory maintenance going forward; a binding court order or agreement can raise separate legal options.
Get advice on the existing arrangement and its enforceability. Do not assume the only option is informal negotiation with the other parent.
If Direct Pay is not working, report the missed payments and ask CMS about moving to Collect and Pay.
CMS cannot take collection action while the case remains on Direct Pay. Once moved to Collect and Pay, the relevant fees and recovery powers can apply.
For cases on CMS Collect and Pay, report any missed payment and check what recovery action is being taken. The service can use its statutory powers, but payment and successful recovery are not guaranteed.
If administrative mistakes caused loss, use the DWP complaints procedure and ask what remedy is available. Compensation is not automatic, and a complaint about service does not replace a calculation appeal.
Where can you find a child support arrears calculator?
If you receive a notice that you are in arrears with your child support payment, it can be tough to understand what to do.
If the amount on your arrears looks wrong, getting a straight answer isn’t always easy.
Ask CMS for a full arrears statement showing assessments, adjustments and payments. The government calculator estimates current maintenance; it cannot reconstruct every historical CSA balance. See related guidance.
A calculator estimate is not a binding decision or proof that arrears are wrong. Compare the actual historic assessments and payment record and raise any specific discrepancy.
For current CMS maintenance, relevant factors include:
- The paying parent’s assessable gross income, with applicable adjustments.
- The number of qualifying children for whom maintenance is due.
- Relevant shared overnight care by the paying parent.
- Other children the paying parent supports under the calculation rules.
If an estimate differs, ask CMS which information and rules explain the difference. A historic CSA assessment may use a different scheme.
Challenge the actual decision with evidence and within the appropriate deadline. A calculator result alone does not determine an appeal.
