Can I get a free divorce after 5 years?

No, you cannot get a free divorce because you have been together or separated for five years.

However, there is the option of seeking legal aid in divorce if you are struggling to pay the fees.

How easy is it to divorce after 5 years of separation?

It’s straightforward to divorce if you qualify for a divorce.

You can apply for the new no-fault divorce and not be required to provide a reason other than the marriage has broken down. The divorce should be approved in four to six months.

You can apply for a no-fault divorce jointly or on your own.

You might need to apply for the divorce alone if you have been separated for five years and cannot contact or locate your spouse.

You’ll be required to show the court that you have done everything possible to notify your spouse that you’re applying for a divorce.

You might need to serve them papers using professional service. Or if you don’t know where they live, you might need to show the court all the different ways you tried to locate them.

Uncontested divorce vs contested divorce

An uncontested divorce is when both people agree to a divorce.

This takes away the need for a court hearing. It takes just four to six weeks for the papers to be processed by the courts.

A contested divorce is when the respondent contests the divorce after receiving the divorce petition from the court. A contested divorce can be more expensive. However, since the change in divorce regulations in April 2022, a divorce can only be disputed for legal reasons.

According to Co-op legal services, in England and Wales 99% of divorce cases are uncontested.

As this MoneySavingExpert forum user states, very few divorces are contested these days. Moreover, the divorce will usually take place in the end.

So, what is the real cost of a UK divorce?

The average cost of the divorce itself is much less expensive than the figure above.

Money Helper states that the average cost of a solicitor is between £450 and £900 for the applicant. And around £250 and £600 for a respondent.

However, since the introduction of no-fault divorces, many cheaper online divorce services exist, and some legal firms offer lower fixed prices. Always do your research before choosing a service.

You could also apply for the divorce online yourself without using a solicitor.

A DIY divorce may be an option if you’re confident about filling out the application form by yourself and are experiencing an amicable and mature split with your spouse.

In these cases, only the application fee of £593 will need to be paid – unless you qualify for a court fee waiver.

You might need to pay solicitor fees to arrange how finances and assets should be divided, namely a Financial Remedy Order.

The cost for one of these depends on the complexity of your finances and the assets you hold. It usually starts at around £350.
