Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Answer below to get started.

How much debt do you have?

What is PO Box 1365, Warrington?

PO Box 1365, Warrington is a mail-handling address. It’s part of the WA55 non-geographic postcode system that many organisations use for sending and receiving high volumes of post. Because it’s a centralised processing address, different companies can use it for their outgoing or return mail, including debt collection firms, law firms, utilities, and public bodies.

So, a letter from this PO Box doesn’t, by itself, confirm which company is writing to you. You need to check the letterhead, company name, reference number, and any client details shown in the body of the letter.

Is your letter genuine or a scam?

Most letters using the WA55 system are genuine, but scam letters do exist. Here’s how to check:

  • Look for the sender’s full company name, company number, and FCA authorisation (if they collect consumer credit debts). Scammers hide or misspell these.
  • Match the reference on the letter with your own records. Genuine letters often quote the original creditor and last four digits of an account.
  • Don’t call the number in the letter straight away. Instead, find the firm’s official website and use their published contact details to verify the letter.
  • Watch for red flags: pressure to pay immediately, threats that don’t fit UK process, or requests for unusual payment methods (gift cards, crypto).

Still unsure? We keep step-by-step guides and letter templates on MoneyNerd to help you verify post safely.

Should you ignore it?

No. Always open and respond appropriately. Ignoring letters can make things worse. If the letter relates to a debt, you have rights. You’re allowed to ask the sender to prove the debt and to pause activity while they do.

First steps: what to do in the next 48 hours

  • Identify the sender. Find the company name, account/reference, original creditor, and balance in the letter.
  • Check if the debt could be too old to enforce. In England and Wales, most consumer debts become statute-barred if there’s been no payment or written acknowledgment for 6 years (5 in Scotland) and no CCJ. If you think this applies, use our free statute-barred letter.
  • Ask them to prove it. If you don’t recognise the debt, or details look wrong, send a prove-it letter. The collector should supply a copy of the original agreement or other evidence. If they can’t, you don’t have to pay.
  • Keep everything. Save envelopes, screenshots, and copies of what you send. Good records help if the matter escalates.

Common reasons you might be contacted

  • Debt collection for credit cards, loans, store cards, BNPL, utilities, or phone bills (either on behalf of the original lender or after sale of the debt).
  • Pre-action letters warning of possible court action if you don’t respond.
  • Local authority or government letters about council tax, benefits overpayments, or fines.

Do you have to pay?

Not straight away. You only need to pay once the debt is correctly proven and enforceable. Here’s how to think about it:

  • If the debt is statute-barred (too old) and there’s no CCJ, it’s not enforceable in court.
  • If they can’t prove the debt with proper documentation, you don’t have to pay.
  • If they do prove it but you can’t afford to pay in full, you can offer an affordable plan based on your budget.

What happens if you ignore it?

If you ignore a genuine pre-action letter, you risk a County Court claim. If a court issues a County Court Judgment (CCJ) and you still don’t engage, they can try to enforce it using bailiffs, attachment of earnings, or other methods. Responding early gives you options and can prevent extra fees.

How to respond safely

  • Write, don’t call first. Use our prove-it letter or statute-barred letter. Keep copies.
  • Never share card details until the debt is proven and you’ve agreed an affordable plan.
  • Use the company’s official website to confirm contact details. Don’t rely solely on the letter.
  • Tell them if you’re vulnerable (health, disability, recent bereavement). Firms must treat you fairly and adjust how they communicate.

Can they take you to court?

They can try, but they should follow the Pre-Action Protocol first. If you respond, request documents, and make a fair offer based on your budget, many cases don’t reach court. If you do receive a Claim Form from the County Court Business Centre, don’t panic. You usually have 14 days to respond (or 28 if you acknowledge service). We have guides to help you complete the forms correctly.

If you can’t afford to pay: your main UK debt solutions

There isn’t a one-size-fits-all answer. Here are the most common options explained simply:

Debt Management Plan (DMP)

An informal plan to pay what you can each month across your non-priority debts. Interest and charges aren’t guaranteed to stop, but many creditors agree to freeze them. Good if your situation should improve later.

Individual Voluntary Arrangement (IVA)

A formal, legally binding agreement, usually lasting 5–6 years. You make one monthly payment you can afford. Remaining unsecured debt can be written off at the end. You’ll need a steady income and at least around £75–£100 spare per month.

Debt Relief Order (DRO)

For people with low income, low assets, and total qualifying debt under the set limit. Costs are low and interest stops. After 12 months, included debts are written off if your situation hasn’t improved.

Bankruptcy

A legal process that writes off debts you can’t repay. It’s serious, with fees and possible impact on assets, but it can give a fresh start. Most people are discharged after 12 months.

Debt consolidation

Replacing several debts with one new loan at a lower rate or payment. This works only if you’re eligible and you don’t build balances back up. Take care with secured loans that put your home at risk.

Every day our partners, The Debt Advice Service, help people find out whether they can lower their repayments and finally tackle or write off some of their debt.
