In some circumstances, you might have a legitimate reason not to pay your parking fine.

Why would you get a UK Car Park Management fine?

The operator could give you a Parking Charge Notice for several reasons. It could be that you’re suspected of committing a significant parking violation.

Or maybe the violation was for minor parking infractions which is often the case.

I’ve listed the more common reasons why you could get a ticket from the operator here:

  • You parked badly over two bays
  • You failed to pay to park
  • Your vehicle was left in a bay reserved for Blue Badge Holders or families with young children
  • You forgot to display a ticket correctly in your vehicle

When you don’t obey Blue Badge parking rules, an operator will issue you with a Parking Charge Notice.

That said, the RAC found that the number of parking tickets being issued is up by nearly 30%! The report also found that misleading and confusing signage in private car parks is part of the problem.2

This means, that a large number of the people who are fined simply made a genuine mistake or accidentally followed poor parking indications.

Do you have to pay?

You should pay or appeal a UK Car Park Management fine within 28 days.

Those agreeing to pay should do so within 14 days so they could only have to pay the discounted fine of £60 instead of £100.

Can they enforce a Parking Charge Notice?

A Parking Charge Notice can be enforced if the private car park operator takes the driver to court. They can summon them to court where the case will be decided by a judge.

In short, you could face court proceeding for parking fines that go unpaid.

If the car park company is operating the car park in line with the Code of Practice and the motorist is guilty of a contravention, the judge will favour the car park company and issue a court order.

If you don’t defend yourself after being summoned to court, the judge can issue a County Court Judgment, which is a default judgement that orders you to pay the fine.

But car park companies don’t always take court action, which is why you’ll often read advice in forums suggesting you ignore the parking ticket.

In my experience, it could work, but it’s very risky and you could end up regretting the decision.

How to appeal the Parking Charge Notice

All Parking Charge Notice appeals made to UK Car Park Management must be made online via their official website.

Your appeal must include reasons why you think the parking fine is incorrect. Plus, you need to back up your statements with supporting evidence

Also, make sure you follow the parking appeals process as set out by the operator. UK PCM then has up to 35 days to respond.

Here’s a quick table summarizing the most common appeal process and its steps.

Process: Steps you should take:
When you receive the ticket… You should gather as much evidence as you can to support your appeal claim and prove that the ticket was unfairly issued.
If you were given the ticket in person/attached to your car… You must make an informal appeal (sent to the local authority/council that issued the PCN) within 14 days. This should be a letter with the evidence proving why the ticket was incorrectly given.
If it was posted to you… You will be given 21 days to submit an informal appeal (from the day you received the letter). Your informal appeal should be a letter with the evidence proving why the ticket was incorrectly given.
If the informal appeal is rejected… You will receive a Notice to Owner and will have 28 days to respond to this with a formal appeal. You can conduct the formal appeal online or via paper form. The Traffic Penalty Tribunal can send you one of these forms.
If the formal appeal is rejected… You will receive a Notice of Rejection. From here, you are free to challenge the council’s verdict at an independent tribunal.
If the independent tribunal disagrees with your appeal… You should pay the ticket within 28 days of the tribunal rejecting your appeal. If you don’t, the fine will be increased by 50%.
If you don’t have the money to pay the fine, you should contact Citizens Advice or another debt charity.

They’ll either accept the appeal and cancel the fine, or they will reject your appeal.

The letter of rejection will tell you how to escalate the matter to a Parking Charge Notice appeals service which is a free and impartial service.
