What are the new Asda parking rules?

New Asda parking restrictions were introduced in an attempt to prevent ‘boy racers’ meeting in Asda car parks at night.

Unfortunately, these new rules are catching many shoppers off guard.

New rules for parking in an Asda car park are:

  • No parking between midnight and 5am Monday through to Friday
  • No parking between 11pm to 5am Saturday in to Sunday
  • No parking between 5pm and 5am Sunday to Monday

Note: These new parking restrictions apply even though shoppers should be allowed 45-minute parking.

Do you have to pay Asda parking fines?

It depends on whether the fine is issued correctly or if the operator (Parking Eye) got it wrong.You may have to pay when you commit a minor parking violation in an Asda car park.

But not before you check if the fine is deserved.

Plus, Automatic Number Plate Recognition errors do happen! We suggest you do the following before you pay the parking ticket:

  • Check the details on the parking fine are correct
  • That you were given a 10-minute grace period. We was recently featured in The Sun2 to help educate people around the 10 minute grace period. This means you can’t be fined if you overstayed by 10 minutes or less.
  • That the ANPR recorded the right arrival and departure time

Remember! A parking fine issued in a private Asda car park is not an official fine. Instead, it’s an invoice that looks like a Penalty Charge Notice the police and councils issue. 

It’s essential to understand the difference between a parking charge notice vs penalty charge notice.

You should challenge the fine if you feel the parking ticket is incorrect or unfair, but you should never ignore one.

Appeal Process Steps

If you believe the ticket was unfairly issued, you have the option to appeal. It’s crucial to understand this process to tackle any obstacles efficiently.

Process: Steps you should take:
When you receive the ticket… You should gather as much evidence as you can to support your appeal claim and prove that the ticket was unfairly issued.
If you were given the ticket in person/attached to your car… You must make an informal appeal (sent to the local authority/council that issued the PCN) within 14 days. This should be a letter with the evidence proving why the ticket was incorrectly given.
If it was posted to you… You will be given 21 days to submit an informal appeal (from the day you received the letter). Your informal appeal should be a letter with the evidence proving why the ticket was incorrectly given.
If the informal appeal is rejected… You will receive a Notice to Owner and will have 28 days to respond to this with a formal appeal. You can conduct the formal appeal online or via paper form. The Traffic Penalty Tribunal can send you one of these forms.
If the formal appeal is rejected… You will receive a Notice of Rejection. From here, you are free to challenge the council’s verdict at an independent tribunal.
If the independent tribunal disagrees with your appeal… You should pay the ticket within 28 days of the tribunal rejecting your appeal. If you don’t, the fine will be increased by 50%.
If you don’t have the money to pay the fine, you should contact Citizens Advice or another debt charity.

What happens when you don’t pay an Asda parking fine?

You could end up in court.

That’s one of the legal implications of non-payment of parking fines.

Parking Eye, the operator could start legal proceedings to recover the debt.

But, first, you’d get a Letter Before Action (LBA). The letter is an attempt to get you to pay, sometimes it works!

Also, the operator may instruct a debt collection agency to send you an LBA rather than do it themselves!

Although a debt collector may sound intimidating, they don’t have any legal powers. But they can take you to court.

How long do You have before You pay the Asda parking fine?

You must pay the fine within 28 days of receiving it. That’s the time limit to pay Asda parking fines. When you pay within 14 days after checking the charge is correct, you pay a reduced amount (40% less!).

Is there a grace period?

Yes. A parking fine should not be issued until the 10-minute grace period is up.

However, the grace period only applies if:

  • You were parked correctly within designated bays
  • You paid the fee to park in an Asda car park

You should ask for the ticket to be cancelled if you weren’t given the 10 minutes grace on returning to your car!
