Consent orders are legal documents that formalise the financial agreement you’ve made with your partner.

This can include things like dividing assets like property, savings, investments, pensions and arranging maintenance payments and child support.

It confirms your agreement and makes it legally binding, which is crucial since a court can’t enforce it later if anything goes wrong until it is made legally binding.

I’ve covered the basic process of getting a consent order below.

  • Disclose your financial details – Provide a financial statement that outlines your income, expenses, assets, and debts. You’ll also need your partner’s financial statement.
  • Fill in form D81 – You’ll have to fill out details about your marriage, children, finances, etc.
  • Reach an agreement on the divorce settlement – Either face to face or by using a mediation service, you and your partner must agree on the divorce settlement.
  • Produce a draft of the consent order – If you need help drafting a consent order, a solicitor or divorce specialist can help. A consent order should be drafted by a solicitor if a standard template won’t do.
  • Ask the court to approve the consent order – The consent order can be submitted, with the fee of £53, to the court once all the info is gathered and you have both reached an agreement.
  • Complete your divorce once the consent order is approved – The final order or decree absolute can be applied for at least 43 days after the conditional order or decree nisi date. Prior to applying for a final order or decree absolute, you should apply to the court for a legally binding arrangement for dividing money and property. In this case, the approval of the consent order that was sent to the court.

If you are working out the divorce settlement with your partner in an amicable manner, you might not even need a solicitor to draft the consent order.

In this case, you can use a standard consent order template.

You can find many examples of consent order templates online, most of which can be modified to fit your needs.

However, depending on the complexity of your assets and financial ties, a generic template may not suit your situation.
