Do I have to pay a Minster Baywatch parking fine?

Technically, you don’t have to pay a Minster Baywatch parking fine unless a judge orders you to do so. The problem is that being taken to court could add extra stress and expense to the process. So ignoring a Minster Baywatch parking fine could result in legal action and having to pay more. 

Should you appeal or pay?

Appealing a Minster Baywatch PCN is free, but it can cost you the 40% discounted rate. By making an appeal you will lose access to the discounted rate, so it may be better to pay the discounted fine if your appeal is weak or lacks convincing evidence. However, this will be a personal decision. 

If you feel strongly that Minster Baywatch have unjustly issued you a parking ticket and you have sufficient evidence, you will probably want to press ahead with a PCN appeal. If so, here’s what the usual appeal process looks like.

Process: Steps you should take:
When you receive the ticket… You should gather as much evidence as you can to support your appeal claim and prove that the ticket was unfairly issued.
If you were given the ticket in person/attached to your car… You must make an informal appeal (sent to the local authority/council that issued the PCN) within 14 days. This should be a letter with the evidence proving why the ticket was incorrectly given.
If it was posted to you… You will be given 21 days to submit an informal appeal (from the day you received the letter). Your informal appeal should be a letter with the evidence proving why the ticket was incorrectly given.
If the informal appeal is rejected… You will receive a Notice to Owner and will have 28 days to respond to this with a formal appeal. You can conduct the formal appeal online or via paper form. The Traffic Penalty Tribunal can send you one of these forms.
If the formal appeal is rejected… You will receive a Notice of Rejection. From here, you are free to challenge the council’s verdict at an independent tribunal.
If the independent tribunal disagrees with your appeal… You should pay the ticket within 28 days of the tribunal rejecting your appeal. If you don’t, the fine will be increased by 50%.
If you don’t have the money to pay the fine, you should contact Citizens Advice or another debt charity.

Can I appeal a Minster Baywatch PCN?

You can appeal a Minster Baywatch Parking Charge Notice as long as your appeal is made by the deadline, which is usually 28 days. If your appeal is accepted the parking ticket will be cancelled and you won’t have to pay.

The appeals process

The Minster Baywatch appeals process starts by making a representation directly to the company. Your appeal should include a valid reason why you didn’t pay for parking, backed up by suitable evidence. 

For example, if all payment machines were broken then you may need photos of the machines not working. Be aware that some private car park signage states that when there is no method to pay you’re not allowed to park at all. 

If your appeal is rejected, you can ask an independent tribunal to look at your arguments and make a final decision. The tribunal can overrule Minster Baywatch. As the company is a member of the British Parking Association, all escalated appeals must be directed to POPLA, which is a free appeals service.

Will they take me to court?

Minster Baywatch is likely to threaten litigation to everyone they contact. However, this doesn’t mean they will definitely take you to court. They may take some people to court, and they may just be trying to scare others to encourage them to pay. They may use a debt collection agency to do this on their behalf. 

Even though parking fines have been reduced, they could still take you to court for smaller amounts. It may be better to assume they will take legal action. This is why you shouldn’t simply ignore a Minster Baywatch PCN.
