Can you go to jail for unpaid library fines?

No, you won’t be sent to jail for an unpaid library fine.

But if you were issued with a court order to pay the fine and refused, the court can give the library further permissions to enforce the debt recovery

This could involve:

  1. The use of bailiffs to come to your home and collect payment or seize goods. This adds expensive bailiff fees to the overall debt.
  2. An Attachment of Earnings Order where some of your income is taken and sent to the library.
  3. A Charging Order is being placed on your property, preventing you from selling it without clearing the debt.

What happens if you don’t pay a library fine?

Libraries may use different strategies to try and get you to pay your library fines. 

Most of them will ban you from taking out any more books until the library fine is cleared, and some might even ban you from the premises altogether and other library services. 

Additionally, some libraries might revoke or suspend your membership due to unpaid fines.

  1. Send frequent letters and reminders asking you to pay
  2. Ask a debt collection agency to chase you for payment

How will a debt collection agency chase library fines?

A debt collections agency is a business that works on behalf of its clients to get individuals to pay an overdue fine or account arrears. They work by sending reminders, text messages, and even calling you to ask you to pay.

There are lots of them around, such as Cabot and Lowell.

A debt collection agency doesn’t have any more legal powers than the library itself. It isn’t a bailiff company, and the debt collection workers cannot come to your home or take your goods. 

There is a chance that the debt collections agency will threaten legal action and a court order to force you to pay. However, this is almost unheard of for library fines, but again, not impossible.

Do unpaid library fines affect your credit score?

Unpaid library fines aren’t shown on your credit report and, therefore, won’t affect your chances of getting approved for credit.

This is because libraries don’t report unpaid fines to credit reference agencies. 

However, if the library were to take legal action and you were issued with a County Court Judgment (CCJ), this would seriously harm your credit rating.

What was the highest library fine ever paid?

In October 2022, the BBC published a fascinating and somewhat funny story about a Coventry man who returned a library book 84 years late on behalf of his grandfather. 

The man who returned the book made a donation of £18.27 on behalf of his grandfather, which he believes would be the total fine had the library’s fine rate been applied. 

However, it was noted that if the library’s current fine of 25 pence per day was applied, he would be owing £7,673.
