Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Answer below to get started.

How much debt do you have?

Why Are You Being Called by 01618081800?

If you’ve received a call from 01618081800, chances are it’s Cerberus Receivables Management, a company specializing in debt collection.

They’re responsible for collecting debts on behalf of different clients.

This is quite common, as debt collection agencies buy billions of debt annually at rock bottom prices – at an average of 10p to £1! 2

CRM debt collectors usually prefer calls over letters because they’re harder to ignore and can be more persuasive.

Cerberus debt collectors call because they want you to pay the entire sum over the phone, which, let’s face it, isn’t always possible.

So, if you can’t pay it all at once, expect questions about your living situation, expenses, and other financial commitments. This might feel invasive, but it’s all part of their effort to understand why settling the entire debt upfront isn’t possible for you.

Their aim is to recover at least some profit from the debt.

Your Rights With Debt Collectors

From what we’ve seen, it’s common for debt collection agencies like Cerberus Receivables Management to threaten you with seizing your assets.

Don’t worry, such actions are not within their authority.

Janine, our financial expert, explained that while debt collectors can visit your home for payments, they cannot come to your workplace, act threateningly, force payment, or discuss your finances with others.

If they violate these rules, you can complain.

I’ve put together this quick table to help you better understand your rights when dealing with debt collectors.

Debt Collectors Can But They Can’t
Contact you by phone or mail. Call you after 9pm or before 8am.
Conduct home visits (on rare occasions) and knock on your door. Forbily enter your home, or stay if you ask them to leave.
Threaten to take you to court by suing you for payment on a debt. Harrass you, including threats of violence, repeated calls and visits, or abusive language.
Negotiate a debt settlement. Tip: make sure to get this new arrangement in writing. Visit your workplace.
Access your bank account, but only after a court judgment has been made. Take anything from your home or threaten to do so.
Sell your debt. Speak to other people about your debt without your permission.
Contact you frequently. Keep doing so if you request that they reduce communications.

Keep in mind that you can request CRM debt collectors to communicate with you in writing rather than over the phone. They should respect your requests. If they don’t, you can also file a complaint.

How a debt solution could help

Some debt solutions can:

Before £587
After £158

Should You Pay or Ignore CRM Debt Collectors?

Even though it might be tempting to let the phone ring and avoid talking to them, ignoring calls from 01618081800 isn’t the best strategy.

We always recommend responding to debt collectors — even just to question the debt’s validity.

You have the right to request proof of the debt.

If the creditor can’t provide evidence to support the debt they’re pursuing, you’re not obligated to pay.

» TAKE ACTION NOW: Fill out the short debt form

It’s also important to note that if your debt has been unresolved for over six years without any payments or communication with the creditor, it may become ‘statute-barred.’

In simpler terms, while the debt technically still exists, it can’t be enforced legally.

However, it’s crucial to keep in mind that this protection only applies to specific debts, and it depends on whether the creditor has made contact or obtained a County Court Judgment against you during that period.

What If You Can’t Pay the Debt?

We understand that CRM debt collectors can be intimidating over the phone, and it’s normal to feel worried about the consequences of not being able to pay the entire debt.

But don’t worry! Cerberus Receivables Management is usually open to arranging a payment plan that fits your budget.

As mentioned earlier, they’ll ask about your current living situation and finances. You should be completely honest, as this is the way in which they’ll be able to come up with a plan that work for both of you.

There are also some solutions available that may help you manage your debt effectively. These are:

  • Debt Management Plan (DMP): Agreement to pay back non-priority debts in one monthly payment.
  • Individual Voluntary Arrangement (IVA): Agreement to pay back all or part of your debts over a set period.
  • Debt Relief Order (DRO): Freezes debt for a year and be potentially written off.

If you want to learn more about other debt solutions, we recommend contacting a debt charity for some free advice. They’ll look at your situation in detail and help you make an informed decision.

Thousands have already tackled their debt

Every day our partners, The Debt Advice Service, help people find out whether they can lower their repayments and finally tackle or write off some of their debt.
