Could you legally write off some debt?

There are several debt solutions in the UK, choosing the right one for you could write off some of your unaffordable debt, but the wrong one may be expensive and drawn out.

Answer below to get started.

How much debt do you have?

This isn’t a full fact find. MoneyNerd doesn’t give advice. We work with The Debt Advice Service who provide information about your options.

Reasons why you were called by 03450020192

Arvato could call you from several numbers. From what we’ve seen, the main reasons they call people are:

  1. To collect payment – Before being called, Arvato Financial, alongside your original creditor, should have sent you a letter stating that the debt has been purchased/transferred2 to the debt collector. If you haven’t received this notice, you have a right to complain.

With this formality having already taken place, Arvato will call you from 03450020192 with the sole aim of getting you to pay the debt there and then over the phone. This will be a request that you make a card payment covering the full amount or that you arrange to make monthly payments until the debt is settled.

  2. To gather more information – The average unsecured debt amount has increased by 27% year-on-year (to £16,174).3 So, many people struggle with debt. If that’s your case, and you cannot pay, then Arvato will ask you to send them your entire income and expenses. With this information being gathered, Arvato will then ask for details about your living situation and whether you own any items of value that could be sold4 to cover the debt, such as a car or an expensive TV.

  3. To intimidate you – Thousands of people across the UK find it easy to ignore debt collection letters as they are often just automated attempts to contact you and seem to hold little weight at first. Debt collectors like Arvato understand this, so they will follow up with a phone call to make the situation more personal and to increase the pressure to pay.

Part of this pressure will include Arvato exaggerating the extent of the situation by threatening court action and home visits during this phone call. Whilst this is a realistic scenario further down the line, it is also just an effort to get you out of your comfort zone so that you pay up sooner rather than later.

Your Rights With Debt Collectors

While Arvato may try to intimidate you, they’re not allowed to harass you.

We’ve put together this quick table that will help you understand what debt collectors can and can’t do. This way, you’ll be able to prevent unfair treatment. To learn more about your rights, please read our detailed guide.

Debt Collectors Can But They Can’t
Contact you by phone or mail. Call you after 9pm or before 8am.
Conduct home visits (on rare occasions) and knock on your door. Forbily enter your home, or stay if you ask them to leave.
Threaten to take you to court by suing you for payment on a debt. Harrass you, including threats of violence, repeated calls and visits, or abusive language.
Negotiate a debt settlement. Tip: make sure to get this new arrangement in writing. Visit your workplace.
Access your bank account, but only after a court judgment has been made. Take anything from your home or threaten to do so.
Sell your debt. Speak to other people about your debt without your permission.
Contact you frequently. Keep doing so if you request that they reduce communications.

Remember, debt collectors can’t enter your home or take any of your possessions. If they’re harassing you, you can make a complaint.
