Why would I get a parking ticket from Ardpark?

You’d get a parking ticket from Ardpark if you don’t obey their Terms and Conditions when using a car park. You’re supposed to follow their rules whenever you use a car park they manage. These must be clearly visible on entrance signs.

If you don’t abide by the rules, the operator is authorised by landowners to give you a parking ticket. Fines are typically issued for minor parking infringements, which include things like:

  • You returned to your car well after an allotted time
  • You failed to park correctly
  • You parked in a bay reserved for the disabled or families with younger children
  • You didn’t pay to use the car park

You may have to pay an Ardpark fine if you broke their T&Cs. But before paying it, you should check the details on the ticket are correct! Plus, the parking ticket was issued per the IPC’s Code of Practice.

Should I pay an Ardpark fine straight away?

You should first check whether the fine has been issued correctly and that the operator followed the IPC Code of Practice. Then, only pay the fine if you’re happy it’s correct. Plus, when you pay the parking ticket within 2 weeks, you get to pay a lower amount.

Note: The Ardpark website still states their fines are set at £100. But the law has changed, and private operators cannot charge more than £50 in areas outside London. But in London, the fines are capped at £80!

Before paying the fine, you should check the following:

  • Did the operator give you a 10-minute grace period before they gave you the parking ticket?
  • Is all the information on the parking fine correct?
  • Was the parking fine sent to you within 2 weeks of you allegedly committing a parking infraction?
  • Did Ardpark follow the IPC’s Code of Practice when they issued the fine?

You could appeal the fine if any of the above apply. But make sure you have evidence to support the appeal. If the parking fine is correct, you should pay it within fourteen days of receiving it, so you pay the reduced amount.

What happens if you ignore Ardpark parking fines?

Although a parking ticket on private land is not legally enforceable from the outset, the operator could take you to court. As such, it’d be a mistake to ignore fines you get on private land!

However, first, you’d get payment reminders from Ardpark. But if you don’t respond, the situation escalates a notch. In short, your details could be sent to a debt collection agency.

It means you’d have to deal with a debt collector!

Then, when you continue to ignore the correspondence and don’t pay the fine, you could receive a Letter Before Action (LBA). It means the operator intends to start legal proceedings against you. You could get a CCJ levied against you.

My advice? Try not to let things get to this stage. Instead, stay in contact with Ardpark and try to pay the fine if you can, or appeal it within 21 days! Plus, the operator may let you set up a payment schedule if you can’t pay the fine in full.

How do I appeal an Ardpark parking fine?

Yes, you can appeal an Ardpark parking fine if you think it’s unfair. But you must file the appeal with the operator within 21 days of receiving it.

Plus, you’ll be asked to provide a good reason why you’re challenging the ticket!

Once you file the appeal, everything goes on hold, and no further action takes place until the operator makes a decision.

You can appeal the fine online and should get a response within 14 days, letting you know if the appeal is successful or not.

What happens if my Ardpark parking ticket appeal is rejected?

If Ardpark rejects your appeal, they’ll send you a Letter of Rejection (LoR). The letter contains information on how to take the matter to the Independent Appeals Service (IAS). This is an independent dispute resolution scheme.

Note: You can’t file an appeal with the IAS if you haven’t already filed one with the operator and received a Letter of Rejection.

Plus, if the IAS rejects your appeal, you’ll have lost your right to pay the lower amount!

Could Ardpark start legal proceedings if I don’t pay the parking ticket?

Yes. A private operator has the right to chase you through the courts for payment if you haven’t paid within 28 days.

My advice? Try to pay the fine within 28 days to avoid legal action. If possible, try to pay within 14 days to pay the lower amount.
