It’s a bit sneaky, but the last time I needed legal advice, I paid £5 for a trial to chat with an online solicitor called JustAnswer.
Not only did I save £50 on solicitor feeds, I also won my case and didn’t have to pay my £271 fine.

*According to Martin Lewis, 56% of people who try to appeal their ticket are successful and get the charge overturned, so it’s well worth a try.
Do You Have To Pay the HX PCN?
This is the real question, isn’t it? Whether you have to pay HX or not. You are under no legal obligation to pay a parking charge notice from a private parking firm at first.
However, it is likely that HX will hound you for payment, and issue increasingly threatening notifications in an effort to get you to pay up. These kinds of strong-arm tactics are typical of private parking firms, don’t be scared by them.
Also, in many circumstances, you could appeal your HX Car Park Management fine.

Why Did You Get an HX Parking Charge Notice?
Under UK law, the definition of a parked car is any vehicle that is stopped, for any period of time, that is not loading or offloading goods or passengers. Unfortunately, on private land, this definition is not in play. For example, the 10-minute grace period for returning to your vehicle after your paid parking time limit is up, may not be upheld by HX.
Therefore, you might find you are given a PCN by HX for reasons that fall outside of the law. Some examples of parking offences you might be accused of when using an HX car park are listed below.
- You overstayed the duration of parking you paid for.
- You did not display the ticket you purchased.
- You parked inappropriately. Taking up more than one space for example.
- You did not display a disabled sticker when parking in a disabled bay.

What if You Don’t Pay the Parking Charge Notice From PX?
We already mentioned that private parking fines are generally not enforceable. In all likelihood, HX will continue to send you demands for payment almost indefinitely. But the company will likely not want to face the risk and cost of taking you to court for the money they say you owe them.
However, if they do take you to court, you might end up having to pay the parking charge notice. But this would be a rare occurrence, especially if you appeal against the PCN.
In very rare cases, you might end up with a County Court Judgement (CCJ) being taken out against you. And this would have a negative impact on your credit score. It would also be recorded on your credit history for some years. However, most courts understand the aggressive, often unethical behaviour of private parking firms. Getting a CCJ against you for a private parking charge is quite unlikely.

The Appeal Process
How long after the offence took place is not a reason to appeal against the PCN. But remember, this is just an invoice. Even though firms like HX like to try and disguise this invoice as an official-looking document, it is not.
If you don’t intend to pay the parking charge, but don’t want to keep receiving letters from HX, demanding payment and threatening further action, you can appeal the charge. There should be details on the document itself telling you how to do this.
Put simply, you just need to tell HX that you do not agree with the parking charge, and are not going to pay it. Once you do this, then HX has its hands tied. Remember, this is an invoice for a parking charge, not a legally enforceable fine.
There are several websites that offer letter templates for refuting a parking charge notice in this way, and it is worth looking up one of these sites. You can use the letter template to appeal the charge and stop HX from chasing you for payment. In most cases, this will be sufficient to get the private parking firm off your back.
